BIS Enforcement
The U.S. Bureau of Industry and Security is the government entity that administers regulations pertaining to exportation and commerce from the United States to foreign countries. In addition to administering export and foreign commerce regulations, the Bureau pursues enforcement actions through its Office of Export Enforcement (OEE) for violations of the regulations. If a violation is found, the OEE has the power to make arrests, execute search and arrest warrants, and detain and seize goods that it believes are being illegally exported.
For one engaged in the exportation of goods to foreign countries, proper compliance with export regulations is critical. Regulations enforced by the OEE are quite dense and complex to understand, however, all U.S. exporters must comply with the requirements of the Controlled Commodity List, the Export Administration Regulations, and the Trade Sanctions Reform Act, among others. Those subject to the regulations include manufacturers, shippers, distributors, brokers, and any other person or entity involved in the exportation of goods.
Ferrari & Associates, P.C. has worked with clients to ensure proper compliance prior to exportation. Compliance before exporting goods is necessary to determine the export regulation(s) applicable to your situation and what processes must be followed in order to legally export goods out of the U.S. Moreover, compliance measures will help to prevent possible arrest and seizure of items intended for export.
Ferrari & Associates, P.C. is also prepared to assist clients seeking to remedy potential violations. The Office of Export Enforcement encourages exporters to voluntarily self-disclose potential violations of any of the export regulations. Due to the precarious nature of a potential export violation, proper representation is necessary in order to secure a favorable outcome and avoid prosecution and other enforcement actions. Ferrari & Associates, P.C. has experience in this area and can help you if you find yourself facing a potential export violation.
If you facing an export control violation contact Ferrari & Associates, P.C. today so that we can assist you in all OEE matters from preparing a voluntary self-disclosure to providing representation if you are faced with any enforcement action brought by the OEE.
